Since our last negotiation update on September 28, 2009 the Supervisor & Deputy/CSO Contract Negotiations Committee (CNC) met with the OCSO approximately 5 times. At the December 2009 negotiations the OCSO failed to follow proper public records notification procedures, so the meeting was canceled.
During the last 5 negotiation meetings, very little or no progress was made on economic articles. There was almost no progress on crucial non-economic articles such as Discipline/Internal Investigations, Promotions, Transfers, Lay Off/Recall and other related articles.
However, 6 basic articles (Strike, Grooming, Compliance to General Orders, Performance review, Acting Ranks, Court Appearances, & Equipment/Service Awards) were mutually agreed to with little or no improvement to the present contract language.
Unfortunately, the OCSO continues to offer “take it or leave it” package proposals. The CNC agreed to certain OCSO proposals articles, but did not agree to their package deal that contains proposals that have potential to hurt our members. The OCSO then promptly removes their package proposal because the CNC declines to accept “all” of the OCSO’s proposals. An “all or nothing, take it or leave it” offer is the OCSO’s standard practice. The OCSO also keeps quickly taking away as many existing benefits as possible through their contract proposals and (Interim) General Order changes while offering no improvement in important areas such as Discipline, Transfers and Promotions, etc.
There is a tentative PERC hearing date on 02-25-2010 to hear the PBA’s Unfair Labor Practice (ULP) Lawsuit regarding your Health Insurance increases and lack of merit pay raises. This PERC hearing date is flexible so please stay tuned to the CFPBA website for further updates.
