After extensive discussion with the Orange County Sheriff’s Office (OCSO) and the Central Florida PBA (CFPBA) leaders, the Orange County Board of County Commissioners (BOCC) voted on June 30, 2009 NOT to appeal to the Florida Supreme Court regarding the 5th DCA’s recent ruling about the Citizen’s Review Board (CRB) being unconstitutional in their pursuit of subpoena and investigative powers. Four county leaders voted for a newly designed CRB that respects the Constitutionality of the Sheriff and abides by the LEO Bill of Rights. Three county leaders voted to respect the 5th DCA’s ruling and take no further action. On several occasions, the PBA and CFPBA were noted as an incredibly powerful law enforcement union that provided input leading to this good decision. In summary, this is an overwhelming vote to restrict or remove the CRB.
I thank all those involved in this major victory for Orange County deputies and members of the CFPBA. Specifically, special thanks to CFPBA attorney Stewart Cohen, CFPBA leaders Marty Premo and Mike Smith, OCSO Sheriff Jerry Demings and his staff attorney Eric Dunlap.
